SuperStar - Terms and Conditions

Important Note: We have withdrawn any and all offerings impacted by changes in India’s laws and stopped accepting funds towards, or enabling the playing of games of skill for real money on our Platform with effect from August 22, 2025. We remain compliant with all applicable laws, and will always continue to do so.

These SuperStar Terms and Conditions (“Terms”) apply if you generate a referral link on the WinZO App; or create and/or share Content with a referral link, voluntarily, or because WinZO has commissioned it. If you have any reservations with the Terms, we ask that you avoid generating a referral link on the WinZO App, or creating and/or sharing the Content.

These Terms govern your participation in WinZO’s SuperStar Referral Programme (“Programme”), an initiative of WinZO Games Private Limited (“WinZO” or “the Company”). WinZO may change, modify and/or terminate the Programme, these Terms, or any policy, FAQ, or guideline relating to the Programme at any time, in its discretion. These Terms are a legally binding document.

The Programme is neither targeted towards nor intended for use by anyone under the age of 18. If you are below the age of 18, you may participate in the Programme only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

  1. If you generate a referral link on the WinZO App, which is then used by multiple unique users to sign up for the WinZO App, you may be eligible to receive certain rewards from WinZO. WinZO may grant rewards, if any, at its sole discretion, and in a form and manner it deems appropriate. You are not entitled to rewards as a contractual right.
  2. You may share, use, publish, promote, distribute, or embed a referral link in an original post, article, blog, video, vlog, audio clip etc. which you have voluntarily created, or WinZO has separately commissioned (hereinafter referred to as “Content”). You may upload the Content on any social media platform or on the internet generally (collectively “Platforms”).
  3. You accept that the Content, and any parts thereof, including any adaptation, translation, or transliteration thereof, is WinZO’s sole and exclusive property. The Content constitutes a ‘work for hire’ for and by the Company. So, all rights, title, and interest in the Content will vest in the Company, immediately upon its creation. The Company may host, store, transfer, use, display, perform, reproduce, modify, create derivative works of, and distribute the Content, including without limitation, use the Content by any means and on any media, whether now known or devised in the future. You agree to extend your complete cooperation and to execute any documentation which WinZO may request, to secure, protect, or enforce, or enhance the aforesaid rights.
  4. You assure WinZO that you will let the Content be uploaded on the Platforms in perpetuity, unless WinZO itself asks that you remove or take down such Content from the Platform(s). If it does, you will immediately remove or take down the Content from the Platforms WinZO asks you to.
  5. You acknowledge that if you generate a referral link, or create or share Content, you act as WinZO’s digital ambassador. So, you must ensure that the Content is original; is not plagiarised, or defamatory, or inappropriate; does not hurt any moral or religious sentiments; does not violate WinZO’s or any third-party’s rights; and complies with applicable laws and relevant Platform policies.
  6. You assure us that you will only promote lawful products or services. And that unless WinZO has given you an explicit written waiver, you will not promote or engage with any third-party product or service which competes with or is incompatible with WinZO’s interests, including, without limitation, by posting about, commenting on, advertising, referring, messaging, or engaging with such product or service’s social media pages or any other Platform presence. You assure us that will never promote illegal products or services; or any products or services which may prejudicially affect WinZO’s interests, its reputation, goodwill, or image.
  7. If you violate these Terms, including, without limitation, by illegally, improperly, or unethically using the Programme, WinZO may, at its sole and absolute discretion, and without notice, restrict, suspend or terminate your access to all or any part of the Programme; deactivate or delete your account and all related information; forfeit and/or claim a refund of the rewards and/or any amounts it may have given to you, along with interest; block, restrict, or forfeit any amounts, prizes, or privileges that you may have received on the WinZO App, or that have otherwise been given to you; claim damages for any and all losses suffered, including loss to reputation, goodwill, business, profit losses, etc.; and may take appropriate legal action. WinZO’s decisions in this respect will be binding upon you, and you will keep WinZO fully indemnified.

Miscellaneous

  1. You will not make any statement, orally or in writing, or perform any act which may adversely affect WinZO’s reputation, image, etc. or may bring WinZO and/or its services/products into disrepute.
  2. You confirm that you have accepted these Terms voluntarily, with your own free will and consent, and without coercion. You agree to abide by these Terms at all times.
  3. You will keep WinZO, its affiliates, employees, and agents, indemnified at all times against any and all claims (including third party claims), liabilities, lawsuits, actions, damages, costs and expenses (including reasonable attorney fees) and demands, which may relate to (i) any breach or alleged breach by you of these Terms; (ii) any reliance by WinZO upon the undertakings, representations, warranties and/or obligations made by you herein; (iii) non-compliance of applicable laws and the relevant policies/terms of the Platforms; (iv) infringement of WinZO’s or any third party’s intellectual property rights in the published Content; and (v) any acts or omissions on your part which may affect WinZO’s reputation, image or any WinZO campaign for promotion of its services/products.
  4. WinZO may, at its sole and absolute discretion, take any actions it deems appropriate for its Programme, and/or in connection with these Terms, including, without limitation:
    • Restrict, suspend, or terminate your access to all or any part of the Programme;
    • Change, suspend, or discontinue all or any part of the Programme at any point of time;
    • Change the rewards mentioned for any category of Programme;
    • Reject, move, or remove any material that may be submitted by you;
    • Deactivate or delete your account and all related information and files on the account.
  5. WinZO will have no liability for any loss of rewards. You must promptly check if any rewards, which WinZO has expressly confirmed as being granted to you, are properly credited to your account. No request for retrospective credit of rewards will be entertained unless WinZO specifies otherwise.
  6. WinZO deducts Tax at Source (“TDS”) per the requirements under applicable laws.
  7. Wherever applicable, you must provide your valid PAN, so that WinZO can file TDS deducted accordingly. If you do not submit your PAN, WinZO will deduct TDS at the rates prescribed under applicable law, and you may not be allowed to credit any more amounts to your account, unless you submit your PAN.
  8. If you provide erroneous, incorrect PAN details, you will be deemed to have not provided their PAN at all.
  9. To facilitate withdrawals, WinZO may charge Users a processing fee at a rate determined by it in its sole discretion, which may vary for different Users. The applicable processing fee at the time of withdrawal is displayed on the withdrawal interface on the Platform at all times.
  10. You remain solely responsible to pay applicable taxes.
  11. In no event will WinZO’s aggregate liability in connection with any claims arising out of or in connection with these Terms, exceed the total amount that WinZO may have paid to you in the six-month period ending on the date of the claim or a maximum amount of One Thousand Indian Rupees (Rs. 1000), whichever is lower. This limitation will apply to any theory of liability whether based on warranty, contract, statute, tort (including negligence) or otherwise, and whether or not WinZO has been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed its essential purpose.
  12. These Terms are governed by and construed in accordance with the laws of India. Any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of New Delhi.
